Terms and Conditions
The Nexforce Terms and Conditions define and establish certain principles to be followed in the development and maintenance of a Nexforce Distributorship and the rights, duties, and responsibilities of each Nexforce Direct Seller.
General declarations
• I declare that I am at least 18years old and a Citizen of India.
• I confirm that I have been completely informed about the products, company and business model by the person who has introduced me to the business (Sponsor). I also confirm that I have registered willingly, without any coercion or undue pressure from anyone.
• I do not have any doubts about the products, company, and the business model.
• I acknowledge that I have read, understood, and agreed to be bound by the Principles & Practices and Code of Ethics of Nexforce Marketing Private Limited.
Know Your Customer
• I agree to complete my Know your Customer (KYC) requirements within 30 days of my registration as a distributor for Nexforce, failing which the company has the rights to block my back office and commissions/incentives/rewards until such time the documents are submitted and accepted by the company.
• I agree to submit self-attested copies of the PAN card, address proof, signature proof and Identity proof under the KYC requirements for the company.
Compensation plan
• I have been informed that the company has a 30-Day Buy Back Policy (calculated from the date of invoice of the product) with relevant conditions for the same.
• I am aware that there is no fee for enrolling as a Distributor, and that there is no compulsion to purchase any products to enrol or otherwise in this business opportunity.
• I have completely understood the company’s compensation plan and the Sales Incentives as published on the company website.
• I understand that the compensation plan of the company may be revised based on the statutory requirements.
• The product purchased from Nexforce.in website will be for my personal usage and not for resale. Purchasing this product does not guarantee that I will earn any commission/income. nexforce pays commission based on my hard work, performance and success in the marketing activities.
Taxes and Legal
• I will be solely responsible for complying with all the relevant taxes and levies as applicable on me from time to time for the sales of products and services.
• I will be solely responsible for obtaining all licenses, registrations and permissions required to run the business as a direct seller from time to time. The company will not be responsible for any deviation and violation of any such legal/statutory requirement from my end.
• I hereby agree that TDS (Tax Deducted at Source) will be deducted by the company from the commissions payable to me.
Direct Seller Obligation
• I confirm that I will respect and adhere to the laws of the country
• I agree to get trained and communicate as authorised by the company and never provide unauthorised information to the prospective direct sellers/customers.
• I agree to provide accurate information about Nexforce’s compensation plan, products and services and sales methods to prospective direct sellers/customers.
• I confirm that I shall not indulge in fraudulent activities or sales and shall take reasonable steps to ensure that I do not indulge in false or misleading representations or any other form of fraud, coercion, harassment, or unconscionable or unlawful means.
• I hereby agree that I will always inform customers about the 30 day buy-back policy, with relevant conditions for the same.
• I confirm that I shall not engage in, or cause or permit, any conduct that is misleading or likely to mislead with regard to any material particulars relating to the direct selling business, or to the goods or services being sold by the company or by me.
• I confirm that I shall not indulge in mis-selling of products or services to consumers.
• I confirm that I shall not use, or cause or permit to be used, any fraudulent, coercive, unconscionable, or unlawful means, or cause harassment, for promoting the company’s direct selling business, or for sale of its goods or services.
• I acknowledge and confirm that I will be, always, an independent direct seller in relation to this Agreement, and will not claim/represent to be an employee of the company. I also understand that all expenses related to the sales of products and services will be solely incurred by me and not the company.
• I hereby declare that I am not engaged and will not engage in any anti-national activities, directly or indirectly, which will also lead to the termination of this agreement.
• I understand and acknowledge that upgrade of systems, processes, terms and conditions is a continuous evolving process and will happen from time-to-time and I agree to abide by the same.
• I hereby agree to send in any complaints to the company on the official email address and give the company 30 days to provide an unbiased resolution according to the policies of the company.
• I agree to receive updates from the company on my registered email address and registered mobile number.
Termination/Resignation
• I agree and acknowledge that in case of the termination of this Agreement due to non-compliance of any condition/s mentioned therein, I will not be eligible to claim any commissions/incentives/rewards and lose the right to conduct business as a direct seller of the company thereafter.
• I agree and acknowledge that in case of my resignation, I will not be eligible to claim any commissions/incentives/rewards and lose the right to conduct business as a direct seller of the company thereafter.
• I understand the right of the company has absolute right to cancel this registration at its sole discretion, without specifying any reasons thereof.
